Welcome to CompuMed mobile app/web portal; a software application (the "Application") provided by CompuMed Services Sdn. Bhd. (CompuMed).

By downloading or using the Application, you agree that you have read and understood the following terms of use (the "Terms") and agree to be bound by them. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, PLEASE EXIT THIS PAGE AND REFRAIN FROM ANY FURTHER USE OR ACCESS TO THE APPLICATION. When using or accessing the Application, you agree that you must comply with any applicable third-party terms of agreement and any additional posted guidelines, rules, terms and conditions applicable to such use, which are hereby incorporated by reference into these Terms.

DISCLAIMER:

THE APPLICATION SHALL BE VALIDLY LICENSED, OF SATISFACTORY QUALITY, FIT FOR THE PURPOSE FOR WHICH IT WAS PROVIDED AND MADE AVAILABLE TO YOU PRIOR TO DOWNLOADING OR INSTALLING IT. YOUR USE OF THE APPLICATION IS VOLUNTARY APPLICABLE LAW

The application is intended for use in Malaysia and the applicable laws shall be the laws of Malaysia. You hereby submit to the exclusive jurisdiction of the Malaysian courts.

LIABILITY

CompuMed shall not be liable in any form for any transactions or disputes between you and any other parties arising out of the use of this application or otherwise save and except arising directly from the negligence, breach or default by CompuMed, its personnel, officers, directors and/or agents.

CompuMed and its affiliates may not be liable for any damages to your electronic devices as a result of your usage to the use of the Application.

LICENCE

CompuMed grants permission to you to use the Application for own personal use and not for commercial purposes, subject to these Terms.

OWNERSHIP

CompuMed is the rightful owner of this application and is protected by applicable intellectual property laws. You may not and shall not facilitate any other party to commit any infringement against this Application with regards to the provision of above laws.

TRADEMARKS

Any logo and trade name appearing on the Application is the property of CompuMed and you may not use them without the written permission of CompuMed.

INFORMATION SUBMITTED

You represent that any information that you have submitted or submit is true, accurate and complete and CompuMed may terminate your use of the Application if any information you provide is false or inaccurate.

You are fully aware of the limits as to your medical policy. You hereby undertake to settle/reimburse any expenses exceeding your entitlement under the said policy contract, or that is not covered by the same.

DISCLOSURE & MONITORING

By using this Application, you hereby irrevocably authorize any organisation, institution, or individual that has any record or knowledge of your health and medical history or treatment or advice that has been or may hereafter be consulted, other personal information or details of related illness/sickness/transaction, to disclose to CompuMed, its panel, your employer or its representative such information (but not limited to) in order to process, pay claims and produce report. You agree that CompuMed, in its capacity as service provider for your employer, or its representative may use or disclose any of the information collected or held to third parties (within or outside Malaysia) in relation to the use of this Application.

SECURITY

You are responsible for maintaining the confidentiality of any password or username provided to you to access the Application and are responsible for all interaction with the Application that occurs with that password or username. You agree to immediately notify CompuMed of any unauthorized use of your password or username and any breach of security relating to your account. CompuMed will not be liable for any loss or damages resulting from the above.

TERMINATION

CompuMed reserve the right to terminate or suspend your use of the Application in the event of any unlawful use by you of this Application or where you have used this Application in contravention of these Terms.

RESPONSIBILITY & ACKNOWLEDGEMENT

You agree that you are responsible for all the charges and cost related to your use of this Application by the external parties such as your Telco provider.

INDEMNIFICATION

You will, be liable to CompuMed and its affiliates, and their officers, directors, employees, agents and licensors from and against all claims, actions, liabilities, losses, expenses, damages and costs arising directly out of or related to your use of the Applications in violation of any application laws or any violation of these Terms by you.

RELATIONSHIPS

By the use of this Application, there is no relationship whatsoever intended or created between you and CompuMed or any other party, be it of Agency, Joint Venture, Employee-employer; or Franchiser-franchisee, etc.

GOVERNING LAW

You agree that these Terms shall be construed in accordance with the laws of Malaysia. Any claim or dispute arising in connection with your use of the Application shall be brought exclusively in the courts of Malaysia. Any cause of action or claim you may have with respect to the Application must be commenced within one (1) year after the cause of action or claim arises. CompuMed's failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. Neither the course of conduct between you and CompuMed nor any trade practices shall act to modify the Terms. CompuMed may assign its rights and duties hereunder to any third party at any time without consent or notice to you.

MISCELLANEOUS

If any provision of these Terms is found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provision. These Terms, together with all policies referred to herein, are the entire Agreement between you and CompuMed relating to the subject matter herein and supersede any and all prior or contemporaneous written or oral agreements or understandings between you and CompuMed relating to such subject matter.
